Special Counsel Jack Smith won't get to put Donald Trump on trial for his alleged January 6th conspiracy before the election – but he may still deliver a September surprise. U.S. District Judge Tanya Chutkan issued a scheduling order Thursday that sets a September 26 deadline for the government to deliver its opening brief on the presidential immunity issue. That gives Smith's team the opportunity to present new information that did not make it into the superseding indictment released last week – including potentially explosive transcripts or other information related to Trump's pressure campaign on Vice President Mike Pence to overturn the election results.
